Our site
We allow access to our sites on a temporary basis, and we reserve the right to withdraw, restrict or change our sites at any time and without notice. We will not be liable if for any reason our sites are unavailable at any time, or if any content is changed or is out of date.
You must treat as confidential any user identification code, password or other security feature relating to our sites, and you must not disclose it to any third party. If in our opinion you are not complying with these terms of use, we have the right to disable any such code, password or feature at any time.
You must comply with our Acceptable Use Policy when using our sites.
It is your responsibility to make sure that anyone who accesses our sites through your internet connection is aware of these terms and complies with them.
Variations
We may revise these terms of use at any time by amending this page, or by notices published elsewhere on our sites. Please check this page from time to time, as the version in force at the time you use our sites is the one that applies to you.
Intellectual property rights
We are the owner or the licensee of all intellectual property rights in our sites and in the material published on them, including our course content, articles, images, videos, designs and the look and feel of our sites. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
You may print off one copy, and download extracts, of any page from our sites for your own personal reference. You must not modify the copies you have made, and you must not use any illustrations, photographs, video or audio separately from any accompanying text.
You must not use any part of the materials on our sites for commercial purposes without a licence from us. In particular, you may not reproduce, republish, share, sell or make available to any third party — in any format, including on another website or in your own training materials — any part of our sites or our course content without our prior written consent.
If in our opinion you are in breach of these provisions, your right to use our sites will cease immediately, and you must either return or destroy any copies of the materials you have made, as we require.
Reliance on information, and medical disclaimer
The contents of our sites, including any links to other sites and resources provided by third parties, are for general information and training purposes only. It is your responsibility to make sure that any products, services or information available through our sites meet your specific requirements.
Nothing on our sites is a substitute for professional medical advice, diagnosis or treatment. First aid guidance is general in nature and cannot take account of an individual's circumstances. If you have a specific question or concern about a medical matter, you should consult a doctor or other healthcare professional. If you think you or someone else may be suffering from a medical condition, seek immediate medical attention. Do not delay seeking medical advice, disregard medical advice, or discontinue medical treatment because of anything you have read on our sites.
We expressly disclaim all responsibility, and shall have no liability, for any loss, injury or damage suffered by you or any third party as a result of reliance on the information or guidance on our sites. Nothing in this paragraph limits or excludes any liability that cannot be limited or excluded by law.
Information about you and your visits to our site
We process information about you in accordance with our Privacy Notice and our Cookie Policy. By using our sites, you consent to that processing and you confirm that all data you provide is accurate.
Uploading material to our site
Where our sites allow you to upload material, post a comment, or contact other users — for example through a blog comment, a course forum or a review — you must comply with our Acceptable Use Policy. If you upload material in breach of that policy and we suffer loss as a result, you will reimburse us for that loss.
Any material you upload to our sites will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose it to third parties. If any third party claims that material you have posted or uploaded violates their intellectual property rights or their right to privacy, we have the right to disclose your identity to them.
We will not be responsible, or liable to any third party, for the content or accuracy of any material posted by you or by any other user of our sites. We have the right to remove any material or posting you make if, in our opinion, it does not meet the content standards set out in our Acceptable Use Policy.
Linking to our site
You may link to our home page, provided that you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. We reserve the right to withdraw linking permission without notice.
You must not link in a way that suggests any form of association, approval or endorsement on our part where none exists. Our sites must not be framed on any other site, and you may not create a link to any part of our sites other than the home page without our written consent. The website from which you link must comply in all respects with our Acceptable Use Policy and must be owned by you.
If you wish to make any use of material on our sites other than as set out above, please email emma@firstaidforlife.org.uk.
Viruses, hacking and other offences
You must not misuse our sites by knowingly introducing any virus, trojan, worm, logic bomb or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our sites, to the server on which our sites are stored, or to any server, computer or database connected to our sites. You must not attack our sites by means of a denial-of-service attack or a distributed denial-of-service attack.
By breaching this provision you would commit a criminal offence under the Computer Misuse Act 1990. Your right to use our sites would cease immediately and we would report the matter to the relevant law enforcement authorities and co-operate with them by disclosing your identity.
Our liability
The material displayed on our sites is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.
We also exclude any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our sites, or in connection with the use of, inability to use, or results of the use of our sites, any websites linked to them and any materials posted on them — including any liability for loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, loss of goodwill, wasted management or office time, and any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law. If you are a consumer, this does not affect your statutory rights.
Jurisdiction and applicable law
These terms of use, and any dispute or claim arising out of or in connection with them or their subject matter or formation — including non-contractual disputes or claims — are governed by and construed in accordance with the law of England and Wales.
The courts of England and Wales will have exclusive jurisdiction over any claim arising from or related to a visit to our sites. If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your own jurisdiction.
